Terms and Conditions for Oubaitori Arts.
These terms and conditions outline the rules and regulations for partnering with our agency for exhibitions, artist representation, and gallery collaborations.
1. Definitions

Oubaitori Arts: Refers to Oubaitori Arts, an art agency that curates exhibitions, represents artists, and collaborates with galleries.

Gallery: Refers to any gallery or exhibition space partnering with Oubaitori Arts.
-
Artist: Any individual or collective whose work is represented, exhibited, or promoted by Oubaitori Arts.
-
Artwork: Any piece of art, including but not limited to paintings, sculptures, digital art, and installations, exhibited or promoted by Oubaitori Arts.

2. Agency Responsibilities

Oubaitori Arts will curate, promote, and manage exhibitions and art shows as agreed with the Gallery.

We will ensure all marketing, installation, and exhibition logistics are professionally handled.

Oubaitori Arts will provide promotional material, including press releases, social media posts, and email marketing, unless otherwise agreed.

3. Gallery Responsibilities
-
The Gallery agrees to provide a suitable space for exhibitions and ensure all necessary facilities, including lighting, security, and climate control, are in place.

The Gallery will coordinate with Oubaitori Arts on exhibition schedules, artwork installations, and dismantling procedures.

4. Pricing Plans
Oubaitori Arts offers the following packages for artists and galleries:
Package One: £220 per year

5 artworks curated into Oubaitori Arts' online gallery and shop.

1 free local exhibition in Northampton.
-
25% off 1 city exhibition (first in London).
-
Press and social media coverage.
-
Email campaign to galleries and buyers.
-
Negotiation & curation of gallery events & exhibitions.

Package Two: £330 per year
-
10 artworks curated into Oubaitori Arts' online gallery and shop.
-
1 free local exhibition in Northampton.
-
25% off 1 city exhibition (first in London).
-
Press and social media coverage.
-
Email campaign to galleries and buyers.
-
Negotiation & curation of gallery events & exhibitions.

Package Three: £550 per year
-
20 artworks curated into Oubaitori Arts' online gallery and shop.
-
1 free local exhibition in Northampton.
-
25% off 1 city exhibition (first in London).
-
Press and social media coverage.
-
Email campaign to galleries and buyers.
-
Negotiation & curation of gallery events & exhibitions.

5. Commission and Fees
-
Oubaitori Arts will receive a 35% commission on sales made during exhibitions.
-
Any additional fees for special services, such as bespoke marketing or installation requirements, will be discussed and agreed upon in advance.

6. Artwork Handling and Insurance
-
The Gallery is responsible for the safe handling and display of all artworks during the exhibition period.
-
The Gallery must provide insurance coverage for all exhibited artworks against damage, theft, and loss while in their care.

7. Promotion and Marketing
-
Oubaitori Arts will actively promote exhibitions through its network, website, and social media channels.
-
The Gallery agrees to support promotional efforts through its channels as well.
​
8. Exhibition Rights
-
Oubaitori Arts retains the right to curate the exhibition layout, design, and presentation of artworks.
-
Any changes to the agreed layout or curation must be approved by Oubaitori Arts in advance.
​
9. Intellectual Property
-
Artists retain all intellectual property rights to their artworks. Oubaitori Arts and the Gallery may use images of the artworks for promotional purposes only, unless otherwise agreed in writing.

10. Termination
-
Either party may terminate this agreement with 30 days’ written notice, provided all ongoing obligations are fulfilled.
-
Termination does not affect any sales commissions due to Oubaitori Arts from completed sales.
​
11. Dispute Resolution
-
In the event of any disputes arising from this agreement, both parties agree to seek mediation before pursuing legal action.

12. Amendments
-
Any amendments to these terms must be agreed upon in writing by both Oubaitori Arts and the Gallery.
